Terms & Conditions for affiliate

By activating your Affiliate Link with Cœur de Mithril, you acknowledge that you have read, understood and accepted without reservation our GCAs.

1-Definitions The terms in bold in GCAs have the following meanings:

  • Affiliate is the client of ''Cœur de Mithril'', having a valid account and subject to the general terms and conditions of use of Cœur de Mithril. In the event that the Affiliate Program is implemented by an employee, employee or any person mandated by a client Cœur de Mithril, it guarantees to be authorized to conclude for the name of the legal person concerned;
  • Commission refers to the sum in Canadian Dollars paid in credit to the Affiliate by Cœur de Mithril in the event of purchase on the shop by one of its sponsors, subject to its final acceptance by Cœur de Mithril;
  • GCA designates these general conditions of affiliation ruling the contractual relationship between Cœur de Mithril and the Affiliate under the Affiliate Program;
  • Sponsor means the natural person (client) whose purchase on Cœur de Mithril will pay a commission to the Affiliate;
  • Affiliate Link means the link generated by Cœur de Mithril and specific to the Affiliate, which is accessible from the Account and may be shared with third parties for subscription;
  • Promotion Tools means all the elements (logos, banners, etc.) made available by Cœur de Mithril to the Affiliate to promote our activity;
  • Party (ies) individually means Cœur de Mithril or the Affiliate and collectively Cœur de Mithril and the Affiliate;

 

  • Affiliate Program means the affiliation program proposed by Cœur de Mithril and ruled by the GCAs allowing the Affiliate, to the extent that the conditions are met, to collect commissions;

 

2-Registration with the program

This Affiliation program offered free of charge by Cœur de Mithril and ruled by this agreement allows the Affiliate, to the extent that the conditions are met, to collect commissions on the sales of his sponsor. By activating your affiliate link on the Affiliate Program tab of our website, you automatically become an Affiliate and are bound by the terms and conditions of this agreement. Your participation in the program is aimed at promoting our activity, legally promoting our website in order to receive a commission on the products purchased by the clients you have referred to us. The Affiliate is deemed to be eighteen (18) years of age or over when enrolled in this program. General Affiliate Terms By activating your Affiliate link with Cœur de Mithril, you acknowledge that you have read, understood and accepted without reservation our GCA.

3-Validity of the agreement

These terms will be effective upon enrollment in our Affiliate Program and will terminate upon termination thereof. It is your responsibility to consult CGAs on a regular basis to review any changes. Indeed, the terms of this agreement can be modified at any time by Cœur de Mithril. In the event that any modification of the CGAs is not acceptable to you, you will be free to terminate this contract immediately. The continuity of your participation in the program is in itself a tacit acceptance by you of any such changes.

4-Affiliate hyperlinks

You can use text links on your website, your blog, your Facebook page and in your emails. The site can also be advertised "offline" in classified ads, stores, and newspapers. You must use the text provided by Cœur de Mithril in your affiliate section - follow-up links.

5-Affiliate Tracking

When a user arrives on our site via your Affiliate Link, a cookie containing your Affiliate Information is placed in its Internet browser. If your sponsor makes a purchase, the system will search for and use that cookie to identify you and assign you the commission.

6-Responsibility of Cœur de Mithril

Cœur de Mithril can under no circumstances be held liable for incidental or consequential damages (loss of commissions) related to affiliate tracking failures or loss of database records. Coeur de Mithril does not grant any guarantee as to the performance or result of the Affiliate Program, nor that third parties will purchase from our Shop from the Affiliate Link. Cœur de Mithril does not guarantee that its affiliate system will not contain anomalies or errors and will operate without interruption or malfunction. In no event shall Cœur de Mithril be directly or indirectly liable for any damage caused to Affiliates or any third party due to the fault of the Affiliates or their use of the Promotion Tools.

7-Responsibility of the Affiliate

The Affiliate undertakes to distribute, under its sole responsibility, the Affiliate Link and Promotion Tools in accordance with applicable laws and practices. The Affiliate guarantees that any participation in the Affiliate Program will be carried out in compliance with the laws in force and the CGU of the social networks and that it complies with the legislation on the protection of personal data. The Affiliate guarantees that it will not modify the Promotion Tools without the prior consent of Cœur de Mithril. The Affiliate shall indemnify and hold harmless Coeur de Mithril (and its affiliates, officers, directors, employees and agents) from and against any claim or demand, including attorneys' fees, for any breach of GCA, misuse of the Affiliate Program, Promotion Tools and Affiliate Link, or violation of any law or rights of any third party. 

8-Revocation of your Affiliate Status

You can terminate your affiliation at any time. Coeur de Mithril reserves the right to suspend or revoke your Affiliate status unilaterally for the following reasons:

- Inappropriate advertisements (false advertisements, deceptive or deceptive hyperlinks)

- Spamming (mass emails used abusively, mass posting in newsgroups or forum without respect for the rules of publication, any form of communication harming our image, etc ...)

- Advertising or any mention made on sites of an illegal nature, containing contents that are illegal or not in conformity with the laws and regulations in force and the rights of third parties (such as racist, defamatory or incitement to any form of discrimination, Extremism) or that may harm the image of the Cœur de Mithril.

- Force through an automated mechanism the association of a visitor with your affiliate account

- Infringement of intellectual property rights

9-Payment of commissions

For each customer order coming from your website or blog, we remunerate you on the basis of 5% of the total of the sale (excluding discounts and promotions). Your statistics can be consulted at any time on your affiliate account. This remuneration will be converted monthly into a purchase credit on the products of our online shop. Commissions are retained for 30 days if the client requests a refund. After this deadline, the amount of your commission will be available on your customer account. This amount is available only in credit for purchases on our online store www.coeurdemithril.com/shop. The credit is issued in Canadian dollars. Exceptionally both parties can agree on a payment system other than purchase credit on the shop. Such an agreement shall be in writing and shall always be in the context of the GCA.
